Please review this Coaching Services Agreement & Terms carefully before purchasing or participating in Better Than Before LLC services.
This Coaching Services Agreement & Terms (“Agreement”) governs participation in coaching, personal training, remote coaching, live virtual coaching, physique transformation, hypertrophy programming, bodybuilding coaching, nutrition education, and related services (“Services”) provided by Better Than Before LLC (“BTB,” “Company,” “Coach,” “we,” or “us”).
By purchasing Services, enrolling in a recurring coaching program, or electronically accepting this Agreement at checkout, the client (“Client” or “you”) acknowledges that they have read, understood, and agree to these terms.

Client understands that online coaching differs from in-person training and carries additional responsibilities and limitations.

10. ATTENDANCE & CANCELLATION POLICY
All in-person training sessions require a 24 hours notice to cancel or reschedule

11. COMMITMENT & CANCELLATION POLICY
Elite Physique Transformation Programs (Everfit-App)
These programs require a minimum 3-month commitment. If you cancel before completing your 3-month commitment, you will be responsible for 50% of the remaining months as an early termination fee.
After the initial 3 months, the program will continue on a month-to-month basis until cancelled. To cancel, you must provide 30 days written notice.
In-Person Training & Remote/Zoom Training
Clients may cancel their program at any time. However, to cancel you must provide 30 days written notice prior to your next billing date.
Any remaining time on your current billing cycle will not be refunded. All cancellations must be submitted in writing via email.
A $150 cancellation fee will be charged upon cancellation.

Better Than Before LLC reserves the right to terminate services for:

13. INTELLECTUAL PROPERTY
All programming, coaching materials, educational content, videos, PDFs, training systems, and written materials remain the intellectual property of Better Than Before LLC.

14. ASSUMPTION OF RISK
Client understands that exercise and bodybuilding-related activities involve risks including:
Clients voluntarily assume all risks associated with participation.
15. RELEASE OF LIABILITY
To the fullest extent permitted under Indiana law, Client releases and holds harmless Better Than Before LLC, its owner(s), coaches, employees, contractors, and affiliates from claims, liabilities, damages, injuries, or losses arising from participation in online or hybrid coaching services, except in cases of gross negligence or intentional misconduct.
16. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Indiana.
Any disputes arising under this Agreement shall be resolved within the State of Indiana.
17. ACKNOWLEDGMENT OF UNDERSTANDING
